Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Limit Break Technologies LLC, a Texas limited liability company ("Limit Break Technologies LLC", "we", "us", "our"), governing your use of the Sim Control desktop app, website, and related services (the "Services"). By creating an account, downloading the app, or subscribing, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

You must affirmatively accept these Terms and the Privacy Policy before creating an account and again before purchasing a subscription. We record the version you accepted and when.

1. Eligibility

You must be at least 16 years old to use the Services and have the authority to enter into these Terms. If you use the Services on behalf of a team or organization, you represent that you are authorized to bind it.

2. The Services; license

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the Services for your own sim-racing use (and your team's, per your subscription). We may update, change, or discontinue features at any time.

Sim Control is a decision aid. It provides strategy, telemetry, timing, and race-control information to help you make decisions. It is not a guarantee of any competitive result, and you are solely responsible for your own decisions and conduct in and around your sim racing.

3. Your account

You must provide accurate information, keep your credentials secure, and are responsible for activity under your account. Notify us promptly of any unauthorized use. You may link third-party sim accounts (e.g., iRacing, Steam) subject to those providers' terms.

4. Acceptable use

You agree not to: (a) reverse-engineer, decompile, or attempt to extract source code except as permitted by law; (b) resell, sublicense, or commercially exploit the Services without our written permission; (c) upload content you do not have the rights to, or that is unlawful or infringing; (d) upload files other than the permitted sim setup/telemetry types, or attempt to misuse an upload path; (e) probe, disrupt, overload, or circumvent security, rate limits, or access controls; (f) access another user's or team's data without authorization; or (g) use the Services to violate any law or third-party right. We may suspend or terminate accounts that violate this section.

5. Your content and data

You retain ownership of the telemetry, setups, results, and other content you upload ("Your Content"). You grant us a worldwide, non-exclusive license to host, store, process, transmit, and display Your Content solely to provide and improve the Services for you and the teams you choose to share with. Sharing Your Content to a team makes it available to that team per the in-app sharing model; content you contributed to a team may remain available to that team after you leave. Our handling of personal data is described in the Privacy Policy.

6. Subscriptions, billing, and auto-renewal

Paid tiers are sold as automatically renewing subscriptions processed by Shopify.

  • Clear disclosure before you pay. Before you provide billing information, we disclose the price, the billing frequency, that the subscription auto-renews until you cancel, the renewal amount, and how to cancel. Your purchase constitutes your express consent to the recurring charge.
  • Renewal. Unless you cancel, your subscription renews automatically at the then-current price for the same term, and your payment method is charged at each renewal.
  • Cancellation — easy and self-service. You may cancel at any time from Account → Manage Subscription in the app; cancellation is at least as easy as signing up. Cancellation stops future charges and takes effect at the end of the current billing period.
  • Refunds. Except where required by law, payments are non-refundable; canceling stops future renewals but does not refund the current period.
  • Price changes. We may change subscription pricing prospectively; we will give you advance notice and the change applies at your next renewal, which you may decline by canceling.
  • Beta. During any closed/free beta period, the Services may be provided at no charge and may change or end; beta features are provided "as is."

7. Third-party services

The Services interoperate with third parties (the sims, Shopify, Discord, and others). Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.

8. Disclaimer of warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or that any strategy, telemetry, or result information is accurate or will produce any particular outcome. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LIMIT BREAK TECHNOLOGIES LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES. IN NO EVENT SHALL LIMIT BREAK TECHNOLOGIES LLC'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE TOTAL AMOUNT YOU PAID TO LIMIT BREAK TECHNOLOGIES LLC IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Limit Break Technologies LLC and its members, officers, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Services or our business and platform; (b) your violation of these Terms or any applicable law; or (c) your infringement or violation of any third party's rights.

11. Termination

You may stop using the Services and delete your account at any time (Settings → Account → Delete Account). We may suspend or terminate your access if you violate these Terms or to protect the Services or other users. On termination, your license ends; sections that by their nature should survive (including §§ 5, 8–10, 12–14) survive.

12. Governing law and venue

These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Except for any dispute subject to arbitration under §13, the exclusive venue and jurisdiction for any dispute shall be the state and federal courts located in Travis County, Texas, and each party consents to personal jurisdiction there.

13. Dispute resolution (OPTIONAL — pending owner decision + counsel; remove if not adopted)

If adopted: Any dispute that cannot be resolved informally shall be settled by binding arbitration administered by [AAA / JAMS] in Travis County, Texas, on an individual basis. You and Limit Break Technologies LLC waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration provision within 30 days of first accepting these Terms by emailing legal@simcontrol.dev. (Consumer arbitration and class-action waivers carry specific disclosure and enforceability requirements — this section must be reviewed and finalized by counsel, or removed in favor of §12 alone.)

14. Changes to these Terms

We may update these Terms. For material changes we will provide notice by email or in-app at least 30 days before they take effect and update the "Last Updated" date. Continued use after changes take effect constitutes acceptance.

15. Miscellaneous

These Terms and the Privacy Policy are the entire agreement between you and us regarding the Services. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.

The liability, indemnity, governing-law, arbitration, and auto-renewal terms must be reviewed by a licensed attorney before launch, and the auto-renewal disclosures must comply with the FTC Negative Option / "Click-to- Cancel" Rule and applicable state auto-renewal laws.
